Terms of sale
The owner of the online store elbrand.ee (hereinafter referred to as the Online Store) is EL LIGHT COMPANY OÜ (registry code 14146859), located at Harju County, Tallinn, Lasnamäe district, Suur-Paala 2a, 13619.
Validity of the sales agreement, product, and price information
The terms and conditions apply when purchasing goods from the Online Store. The prices of the products sold in the Online Store are indicated next to the products. The delivery fee is added to the price. The cost of delivery depends on the buyer's location and the delivery method chosen. The delivery fee is displayed to the buyer during the order process. Information about the products is provided directly next to the products in the Online Store.
Placing an order
To order goods, the desired products must be added to the shopping cart. To complete the order, required fields must be filled in, and an appropriate delivery method selected. The total cost will then be displayed, which can be paid via a bank link or other payment solutions. The agreement is effective from the moment the payment is credited to the Online Store’s bank account. If it is not possible to deliver the ordered goods due to them being out of stock or for any other reason, the buyer will be notified as soon as possible, and the paid amount (including delivery costs) will be refunded immediately, but no later than within 14 days from the notification.
Delivery
Goods are shipped to the following countries: Estonia, Latvia, Lithuania, Poland, Finland, Austria, Belgium, Bulgaria, the United Kingdom (Northern Ireland), Ireland, Hungary, Germany, Greece, Denmark, Spain, Italy, Cyprus, Luxembourg, Malta, Monaco, the Netherlands, Portugal, Romania, France, Croatia, the Czech Republic, Sweden, Norway. The shipping costs are covered by the buyer, and the relevant price information is displayed with the chosen delivery method. Domestic shipments within Estonia generally arrive at the designated destination within 3-7 business days from the date the sales agreement takes effect. Deliveries outside Estonia are made within 10 business days. In exceptional cases, goods can be delivered within 45 calendar days.
Right of withdrawal
After receiving the order, the buyer has the right to withdraw from the agreement concluded in the Online Store within 14 days. According to Section 53, subsection 4, point 41 of the Law of Obligations Act, the right of withdrawal may not apply if the purchased product has been used after delivery. The right of withdrawal does not apply if the buyer is a legal entity. To exercise the 14-day return right, the ordered goods must not be used for purposes other than necessary to verify the nature, characteristics, and functionality of the goods, as would be allowed when testing the goods in a physical store. If the goods have been used for other purposes or show signs of use or wear, the Online Store has the right to reduce the refundable amount in proportion to the decreased value of the goods. To return the goods, a withdrawal form must be filled out (found here: withdrawal form) and sent to the provided email address no later than 14 days after receiving the goods. The buyer bears the return costs, except when the return reason is that the goods do not match the order (e.g., wrong or defective item). The buyer must return the goods within 14 days of submitting the withdrawal notice or provide proof that they handed over the goods to a courier during this period. The Online Store will refund the buyer immediately upon receiving the returned goods, but no later than 14 days after receiving the withdrawal notice. The Online Store may refuse to issue refunds until the goods have been returned or until the buyer provides proof that the goods have been sent back, whichever occurs first. If the buyer has explicitly chosen a delivery method other than the least expensive standard delivery option offered by the Online Store, the Online Store is not obligated to refund the excess cost. The Online Store reserves the right to cancel the sales transaction and request the return of the goods if the price of the goods in the Online Store was significantly below market value due to an error.
Right to file a complaint
The Online Store is responsible for non-conformities or defects in the goods sold that were present at the time of delivery to the buyer and that become apparent within two years from the date of delivery. For the first six months from the delivery to the buyer, it is assumed that the defect existed at the time of delivery. The Online Store must disprove this assumption. The buyer has the right to contact the Online Store within two months of discovering a defect, by sending an email to elightbrand@gmail.com. The Online Store is not responsible for defects that occur after the delivery of the goods to the buyer. If the goods purchased from the Online Store have defects for which the Online Store is responsible, the store will repair or replace the defective goods. If it is not possible to repair or replace the goods, the Online Store will refund the buyer for all costs incurred under the sales agreement. The Online Store will respond to the consumer’s complaint in writing or in a format that allows written reproduction within 15 days.
Direct marketing and processing of personal data
The Online Store uses the personal data entered by the buyer (name, phone number, address, email address, bank details) solely for processing the order and delivering the goods to the buyer. The Online Store forwards personal data to the companies providing delivery services in order to deliver the goods. The Online Store sends newsletters and offers to the buyer’s email address only if the buyer has expressed their wish by entering their email on the website and indicating their desire to receive direct mail notifications. The buyer can opt out of receiving offers and newsletters at any time by notifying us via email or by following the instructions in the promotional emails.
Dispute resolution
If the buyer has complaints regarding the Online Store, they should be sent to elightbrand@gmail.com. If the buyer and the Online Store cannot resolve the dispute through mutual agreement, the buyer can turn to the Consumer Disputes Committee. The conditions for the procedure can be found, and the application can be submitted here. The Consumer Disputes Committee is competent to resolve disputes arising from the agreement between the buyer and the Online Store. Review of the buyer's complaint by the committee is free of charge. The buyer can also turn to the European Union's Online Dispute Resolution platform.
